These Terms of Use (“Terms”) govern the use of services provided by CapyServer, a product of Myklnet Sdn Bhd, Reg. No: 202101009572 (1409871-H) (“CapyServer,” “we,” “our,” or “us”). By accessing, registering, or using our hosting, dedicated server, or related services, you (“Customer,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, you must discontinue use of our services immediately. These Terms are enforceable under the laws of Malaysia, including but not limited to the Contracts Act 1950, the Communications and Multimedia Act 1998, the Consumer Protection Act 1999, and the Personal Data Protection Act 2010.

1. Eligibility
You must be at least 18 years old or of legal contracting age under Malaysian law to use our services. By registering, you represent that all information provided is accurate, complete, and current.

2. Account Registration
Customers are responsible for safeguarding account credentials. Any activities under your account will be deemed your responsibility. You must notify us immediately of unauthorized access.

3. Services Provided
CapyServer provides web hosting, dedicated servers, and related IT services. Services are subject to availability, technical limitations, and compliance with these Terms.

4. Acceptable Use Policy
Customers must comply with all applicable Malaysian laws. Prohibited activities include hosting illegal content, spamming, phishing, launching DDoS attacks, or distributing malware.

5. Customer Responsibilities
Customers are solely responsible for the content hosted, domain names registered, and activities conducted using our services.

6. Payment Terms
Services are billed in advance in Malaysian Ringgit (RM). Non-payment may result in suspension or termination. Refunds, if applicable, follow our Refund Policy and Malaysian consumer laws.

7. Pricing and Changes
CapyServer reserves the right to revise service pricing, billing cycles, or features with reasonable notice to customers.

8. Service Availability
While we strive for high uptime, we do not guarantee uninterrupted service. Planned maintenance or unforeseen outages may occur.

9. Data Privacy
CapyServer complies with the Personal Data Protection Act 2010. We collect and process customer data strictly for service delivery in accordance with our Privacy Policy.

10. Security
We implement reasonable security measures but cannot guarantee complete protection against cyber threats. Customers must secure their accounts, applications, and data.

11. Backups
Customers are responsible for maintaining their own data backups. CapyServer may provide backup services but does not guarantee integrity or completeness.

12. Intellectual Property
All systems, software, and trademarks of CapyServer remain our property or that of licensors. Customers may not copy, modify, or resell our intellectual property.

13. Third-Party Services
CapyServer may integrate with third-party services (e.g., cPanel, Cloudflare). Use of such services is subject to their respective terms.

14. Suspension and Termination
We may suspend or terminate services for violations of these Terms, non-payment, or requests from Malaysian regulatory bodies such as the MCMC.

15. Limitation of Liability
To the maximum extent permitted by Malaysian law, CapyServer shall not be liable for indirect or consequential damages. Liability is limited to fees paid in the preceding three (3) months.

16. Indemnity
Customers agree to indemnify and hold CapyServer, Myklnet Sdn Bhd, and affiliates harmless against any claims arising from misuse of services or violation of laws.

17. Force Majeure
We are not liable for delays or failures caused by events beyond our control, including natural disasters, cyberattacks, or government actions.

18. Amendments
CapyServer reserves the right to amend these Terms at any time. Updates will be posted on our website, and continued use signifies acceptance.

19. Governing Law
These Terms are governed by the laws of Malaysia. Disputes shall be subject to the jurisdiction of the courts of Malaysia.
